Building Owners Surveyor – As a building owner planning construction work within 6 meters of a neighbour’s property you may have obligations under the Party Wall etc. Act 1996. Brennan Associates are specialist at advising building owners on these responsibilities and can be appointed by you as the ‘building owners surveyor’. We have experience in providing advice and to act for a range of different owners both commercial and homeowner and are comfortable working on multi-million-pound projects or minor residential developments alike. Where possible we will provide you with a fixed-fee quote for our services or where this cannot be provided are able to act at very competitive rates.

Adjoining Owners Surveyor – As an adjoining owner you may have been served notice by a neighbouring property owner notifying you of their intention to undertake works covered by the Party Wall etc. Act 1996. Under many parts of this act you will be called upon to appoint a surveyor as the ‘adjoining owners’ surveyor. Our surveyors are specialists in acting in this capacity. We are also happy to provide initial telephone advice on any party wall situation and welcome your telephone call or email on these matters.

Agreed Surveyor – Within the Party Wall etc. Act 1996 there are provisions for both the building owner and the adjoining owner to confer in the appointment of a single surveyor known as the ‘agreed surveyor’. Our surveyors frequently act in this capacity and in many cases, we can do this at no extra cost when compared with acting as a building owner or adjoining owner’s surveyor. It is not always appropriate or advisable to appoint an agreed surveyor and if we think this is the case, we are happy to advise as such and explain why.

Licences for Oversailing and Occupation – Licences concerning neighbourly matters can take various forms and it is important to ensure that where permission is required by others for undertaking project or maintenance work that this is recorded in a robust way and compensates those who are inconvenienced. Brennan Associates has experience in negotiating and agreeing licences for occupation and oversailing with a variety of adjoining parties including domestic owners and corporate organisations.

Advisory – There are a wide variety of neighbourly matters issues which can cause problems in delivering projects or which can cause loss of enjoyment from your property. These include issues relating to rights of light, boundary disputes & easements, wayleaves & rights of way. We can provide initial advice on these issues and work alongside your specialist advisors in these areas to ensure a satisfactory solution for all.
